Welcome to Tones, a platform operated by Tones by Salome Ltd("Tones", "we", "us", or "our"), a company registered in the United Kingdom (registered office details to be updated) (the "Company").

These Terms and Conditions (the "Terms") govern your access to and use of Tones' website, mobile application, and related services (together, the"Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Service.

1. Eligibility

The Service is intended for individuals aged 18 years or older. By using the Service, you confirm that you meet this requirement and have the legal capacity to enter into a binding agreement.

2. Account Registration

Certain features of the Service require you to create an account. When registering, you agree to:

• provide accurate, current, and complete information; and
• keep your account information updated.

You are responsible for maintaining the confidentiality of your login details and for all activity carried out under your account.

3. Use of the Service

Tones is a creative and professional platform designed to support creative opportunities, talent discovery, collaboration, project management, community-building, and events.

You agree to use the Service lawfully and responsibly. You must not:

• (a) infringe intellectual property or privacy rights;
• (b) use the Service for unlawful or fraudulent purposes;
• (c) interfere with the security or functionality of the Service;
• (d) send spam, unsolicited promotions, or misleading communications;
• (e) scrape, mine, or extract data without permission;
• (f) upload malicious code, viruses, or harmful files;
• (g) impersonate another person or access another user's account;
• (h) upload content you do not have the right to share;
• (i) post content that is defamatory, abusive, obscene, threatening, or otherwise illegal.

We do not guarantee that the Service will always be error-free, uninterrupted, or suitable for any specific purpose.

4. Opportunities & Talent Services

Tones provides a platform that connects creatives, talent, collaborators, and organisations (together, "Users") for opportunities including but not limited to:

• freelance and employment opportunities;
• creative collaborations;
• talent discovery and representation;
• asset sharing and project coordination.

Tones may use internal tools or algorithms to suggest matches based on skills, interests, and other data. Final decisions always remain with Users, and Tones does not guarantee outcomes, engagements, or success of any opportunity.

Tones is not a party to any agreement entered into between Users.

5. Events, Shows & Community Experiences

Tones or its partners may organise or promote events, showcases, workshops, or community experiences ("Events"). Events may be ticketed or invite-only.

Additional terms may apply to Events and will be provided at the point of registration. Tones reserves the right to modify or cancel Events with reasonable notice.

6. Waitlists & Early Access

Some features of Tones may be released gradually or accessed via a waitlist. Placement on a waitlist does not guarantee access within a specific timeframe. Tones may prioritise access at its discretion.

7. Creatives & User Content

If you are a creative or contributor, you may upload or share content such as portfolios, CVs, media, messages, and project assets ("User Content").

• You retain ownership of your User Content;
• You grant Tones a non-exclusive, royalty-free, worldwide licence to use, display, and distribute such content solely to operate and promote the Service.

You are solely responsible for your User Content and any interactions with other Users.

You agree to keep confidential any non-public information obtained through the Service.

8. Platform Guidelines

By using Tones, you agree to:

• (a) act professionally and respectfully;
• (b) comply with employment, data protection, and applicable local laws;
• (c) respect intellectual property and personal data rights.

9. Third-Party Links

The Service may include links to third-party websites or services. Tones does not control or endorse these and is not responsible for their content, policies, or practices.

10. Information Submission

Information you submit may be processed by Tones and its service providers in accordance with our Privacy Policy. You are responsible for reviewing third-party policies where applicable.

11. Fees & Payments

Where applicable, fees ("Fees") for paid features or services:

• (a) are payable in advance;
• (b) are non-refundable unless otherwise stated or required by law;
• (c) exclude VAT or applicable taxes;
• (d) may be updated with reasonable notice.

12. Linking to Tones

You may link to the Service in a fair and lawful manner that does not imply endorsement or partnership without our written consent.

13. Platform Disclaimer

Tones provides a platform only and does not:

• vet or guarantee Users;
• guarantee job placements, earnings, or opportunities;
• supervise or control collaborations or contracts.

14. Reporting & Complaints

You may report content or behaviour that breaches these Terms by emailing hello@tonesbysalome.com.

15. Changes to the Service or Terms

We may update or modify the Service or these Terms at any time. Updated Terms will be posted on the platform, and continued use constitutes acceptance.

16. Intellectual Property

All intellectual property rights in the Service (excluding User Content) belong to Tones or its licensors.

17. Privacy

Our Privacy Policy governs how we collect and use personal data and is incorporated into these Terms by reference.

18. Disclaimers

The Service is provided on an "as is" and"as available" basis. We disclaim all warranties to the maximum extent permitted by law.

19. Limitation of Liability

To the fullest extent permitted by law, Tones shall not be liable for indirect, incidental, or consequential losses.

Our total liability shall not exceed:

• the fees paid by you in the 12 months preceding the claim; or
• £100 where no fees have been paid.

20. Indemnity

You agree to indemnify and hold harmless Tones from any claims arising from:

• (a) your use of the Service;
• (b) your breach of these Terms; or
• (c) your infringement of third-party rights.

21. General

These Terms are governed by English law, and the courts of England and Wales have exclusive jurisdiction.

If any provision is held invalid, the remaining provisions shall remain in effect.
